Types of bankruptcy:

Since 2005, Congress has imposed a "means test" to determine whether individuals are qualified for Chapter 7 relief. Those with mortgage payments and car loans can usually retain their property and continue paying on these debts.
  • Chapter 13: Consumer reorganization, this type of bankruptcy involves paying on a plan for 3 to 5 years, dependent upon the circumstances. It is an option for those who are behind on house or car loans, as it allows one to keep the property and pay back the arrears over time, or to pay the value of the property over time. It also is available for those who do not qualify for Chapter 7 relief, and can be advantageous for tax debts.
  • Chapter 11: Business reorganization, a complex bankruptcy process available for individuals and businesses to reorganize their finances and continue in business.
